Workers and Technology

We specialise in safeguarding workers' rights in the digital age, offering expert legal and policy advice on the use of data and technology in the workplace. Our team has extensive experience assisting workers and unions in relation to access to personal data, understanding algorithmic decision-making processes, and challenging unfair practices in the context of regulatory and threatened civil proceedings.

We also support employers in developing and implementing policies that leverage innovative technologies while ensuring compliance with data protection laws and upholding employee rights.

Our work in this area includes challenging infringements of workers' data rights in the gig economy and addressing the workplace implications of Generative AI. For leading workers’ data rights organisation Worker Info Exchange, we drafted a major regulatory complaint to the ICO regarding transparency standards for automated processing in the gig economy.

We have also developed and advised on Generative AI workplace use policies, including the creation of a Generative AI Toolkit for the Trades Union Congress, representing 48 trade unions in the UK. Additionally, we have provided guidance to FIFPRO on empowering professional footballers to assert control over their personal data.

As well as assisting in the exercise of data subject rights, we have experience in advising clients in this sector on pragmatic responses to data subjects’ requests. We are retained by unions such as UNISON to deal with data rights requests and disputes regarding data protection between unions and employers.

We are increasingly called on by clients to advise on novel and complex workplace issues relating to generative AI. We act for Equity – the performing artists’ union – in a significant project to use data rights to rebalance power in the generative AI supply chain. We have also acted for freelance clients in relation to complex copyright disputes arising out of the use of generative AI/deepfake technology in the creative sector.

Our commitment to workers' digital rights has been recognised in media outlets, including Context, which featured our insights in the article "Your manager is an algorithm. Here’s how to fight back".
